Terms of Service

1. Acceptance

These Terms govern your access to AI Search Vitals ("AI Search Vitals", "we", "us", or "the Service"). By creating an account, purchasing a plan, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

AI Search Vitals runs saved prompts against configured AI models and helps users review brand mentions, competitor mentions, citations, raw answers, and changes over time. Features, supported providers, models, limits, and schedules may change as the Service develops.

3. Measurement Limitations

AI-generated answers are probabilistic and may be incomplete, inaccurate, outdated, or different between runs. A result is an observation from the provider, model, configuration, location, language, and time identified with that run.

Results are not an official or universal ranking from ChatGPT, Claude, Perplexity, Google, or any other platform. A model accessed through OpenRouter may not reproduce the first-party product experience and may not have live web search unless the run is explicitly labeled as using a supported search mode. You must verify important results before relying on them for business, legal, financial, or other decisions.

4. Accounts

You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized use. You are responsible for activity performed through your account and for ensuring that anyone you authorize follows these Terms.

5. Your Data and Instructions

You retain your rights in brand data, domains, competitor lists, prompts, and other content you submit. You grant us a limited right to host, reproduce, transmit, and analyze that content only as needed to operate, secure, support, and improve the Service.

You represent that you have the right to submit the content and that your monitoring activity complies with law and third-party rights. Do not submit confidential or sensitive data that is not necessary for the monitoring task.

6. Acceptable Use

You may not:

use the Service unlawfully or to violate intellectual-property, privacy, publicity, or other rights;
submit malware, secrets obtained without authorization, or content intended to harm or deceive;
probe, disrupt, overload, bypass limits, or gain unauthorized access to the Service;
reverse engineer or copy protected parts of the Service except where law expressly permits;
resell or provide shared access to the Service unless your plan or a written agreement allows it; or
misrepresent monitoring observations as official platform rankings or endorsements.

7. AI and Other Third-Party Services

The Service depends on Cloudflare, OpenRouter, underlying model providers, and other configured vendors. Their availability, output, policies, pricing, and geographic restrictions may change without our control. You must also comply with any third-party terms that apply to your use.

We may replace, suspend, or remove a provider or model when necessary for security, compliance, reliability, or cost control.

8. Plans, Billing, and Limits

Paid plans renew according to the interval and price shown at checkout until canceled. Taxes, currency conversion, payment processing, cancellation timing, and refund eligibility are governed by the checkout terms, payment processor, and applicable law.

Plans may include prompt, run, token, storage, concurrency, export, or fair-use limits. We may pause runs that exceed plan limits, create unusual load, or threaten Service reliability. Price changes apply prospectively after any notice required by law.

9. Service Changes and Availability

The Service may be modified, interrupted, or discontinued. We may perform maintenance and cannot guarantee that a provider, model, citation format, historical comparison, or scheduled run will always be available or unchanged.

10. Intellectual Property

The Service software, design, documentation, and branding are owned by us or our licensors and are protected by applicable law. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the Service during your account term. No other rights are granted.

Feedback may be used without restriction or compensation, provided we do not publicly identify you without permission.

11. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access for material breach, unlawful activity, security risk, non-payment, abusive usage, or where required by a provider or law. Where practical, we will provide notice and an opportunity to export data, but urgent security or legal circumstances may require immediate action.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not guarantee increased traffic, citations, sales, search placement, AI recommendations, or any specific business outcome.

13. Limitation of Liability

To the maximum extent permitted by law, we and our suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the Service. Our aggregate liability for claims relating to the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim, unless applicable law requires otherwise.

14. Indemnity

To the extent permitted by law, you agree to defend and indemnify us and our affiliates, personnel, and suppliers against third-party claims arising from your submitted content, unlawful use, violation of these Terms, or infringement of another person's rights.
